Welcome to DeskServ. These Terms of Service (“Terms”) govern your access to and use of the DeskServ website, dashboard, APIs, widgets, and related services (collectively, the “Service”).

By creating an account or using DeskServ, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. About DeskServ

DeskServ is a Jamaica-based company providing AI-powered customer communication tools for Caribbean and international businesses. Our infrastructure is hosted in Germany.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your login credentials and for all activity that occurs under your account.

3. Free Trials & Billing

DeskServ may offer free trials. At the end of a trial, continued use of the Service may require a paid subscription. Usage limits apply based on your selected plan.

4. Acceptable Use

You agree not to misuse the Service, including but not limited to:

Sending spam or unlawful content
Attempting to bypass usage limits or security controls
Using the Service to violate applicable laws or regulations

5. AI Responses

DeskServ provides AI-generated responses based on customer-provided data. AI outputs are not guaranteed to be error-free and should not be relied upon as legal, medical, or financial advice.

6. Data & Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect and process personal data.

7. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted availability. Maintenance, outages, or third-party failures may occur.

8. Termination

We reserve the right to suspend or terminate accounts that violate these Terms or misuse the Service.

9. Limitation of Liability

To the maximum extent permitted by law, DeskServ shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service.

10. Governing Law

These Terms are governed by the laws of Jamaica. Where applicable, data protection obligations under European law (GDPR) also apply due to server location.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.
